Although we know that, literally, Peruvians are God’s People, sometimes even Peruvians have the worst possible luck. Such was the case with Gaby Tapia, from Huacho, Peru, this past November 28, 2007. Thankfully, Peruvians like Ms. Tapia have friends in prominent places, in this case Honorable Allan Kaiser, former federal prosecutor, who rescued Ms. Tapia -- she runs a shipping, courier, business for packages to and from Peru -- from accusations that she knew about, and/or was involved in, some drugs which four customers smuggled into packages they shipped through her agency. If you’ve ever been afraid of the U.S. government, you should read on to learn of this nightmarish, yet heroic, tale, of good triumphing over evil.
Gavi Tapia owns and operates A & J Tours, at 13756 S.W. 84 Street, in the Kendall area of Miami. Gavi’s travel agency has been in business since more or less 10 years, and she is available to all to book travel to and from Peru, and anywhere else people travel to. In addition to her travel business, Ms. Tapia also runs a courier shipping business.
Most Peruvians are familiar with couriers as an alternative for shipping packages to and from the United States and Peru. Whereas U.S. people usually use the U.S. Mail, or U.P.S., or FedEx, or DHL, to ship packages, Central and South Americans, including Peruvians, often prefer to ship their packages through couriers—i.e. through companies who charge a fee to pack suitcases, which travelers carry on planes travelling to and from different destinations. The latter can avoid excessive surcharges often irrationally imposed in Peru, or other destinations, resulting, say, in a shipment of $20 worth of goods, costing $50 for shipping.
Ms. Tapia advertised her travel agency, and he courier business, in prominent publications, such as El Diario Latino, El Peruanissimo, and Contigo Peru in USA.
Unfortunately for Ms. Tapia, some customers decided it can not only be profitable to ship drugs through the U.S. Mail – a common occurrence, thoroughly documented in hundreds of criminal cases throughout the country (but the U.S. Postal Service never gets indicted). And these nefarious customers decided it can not only be profitable to ship drugs through the United Parcel Service, or FedEx, or DHL – which also happens virtually every day, every week, every month, every year, as is documented in 100’s of criminal cases throughout the country (yet United Parcel Service, FedEx, and DHL never get indicted for their service being illegally utilized in this way). These particular customers decided it would be profitable to use the human courier shipping business, and in particular AJ Tours shipping business, to smuggle drugs from Peru into the U.S.
Neither Ms. Tapia, nor the couriers she paid minimal amounts to carry packages, had any idea that two recipients in Miami, and two senders in Peru, were taking advantage of their shipping business, to smuggle cocaine in artesania clocks from Peru. When, completely unbeknownst to Ms. Tapia, or her couriers, the suitcases they were carrying for her, on flights on November 28, 2007, from Lima to Miami, were passed through customs, technology and/or dogs did discover these smuggled items of clocks containing cocaine.
Federal Agents were properly suspicious of the couriers, and of Ms. Tapia, and properly followed through to arrest the recipients of the clocks in Miami – the arrest with which Ms. Tapia’s A & J Tours Travel Agency cooperated and assisted. Although the ICE (Immigration and Customs Enforcement) Agents properly released the couriers as unknowing, for some reason they assumed Ms. Tapia was part of a conspiracy, and indicted her, whereupon she faced potential 10 years minimum incarceration, despite being absolutely, completely, as innocent as the U.S. Postal Service, United Parcel Service, FedEx, and DHL.
Fortunately, Contigo Peru Magazine’s Publisher, Julio Rey, and Member of the Board of Directors, Rip Holmes, knew former federal prosecutor Allan Kaiser, who had recently gone into private practice, after working 18 years as an Assistant United States Attorney.
Allan Kaiser not only agreed to represent Ms. Tapia, but gave her a price which she could afford – it would be embarrassing to him to tell the reader how little he charged Ms. Tapia upon realizing she was truly innocent. This was something all Peruvians should be grateful for, a gift from Heaven, for God’s People.
For seven agonizing months, Ms. Gaby Tapia, represented by Allan Kaiser, had to face to possibility of going to prison, for something she hadn’t done, for a minimum of 10 years, because third parties, who were guilty, had taken advantage of her business.
Finally, Allan Kaiser, working for an embarrassingly little amount of money from hard-pressed Ms. Tapia, convinced his former colleagues, the federal prosecutors, that Ms. Tapia was as innocent as the U.S. Postal Service, the United Parcel Service, FedEx, and DHL, of any involvement, whatsoever, in the actions of the true criminal drug smuggling conspirators.
The federal prosecutors finally listened to their former colleague, Peruvians’ rescuer, Allan Kaiser, and dismissed their unfounded case against Ms. Tapia, on June 19, 2008.
